Who Are the Defendants in the Hernia Mesh Lawsuits?
According to the U.S. Judicial Panel on Multidistrict Litigation, there are two MDLs currently pending. These include cases against:
C.R. Bard, Inc., and Related Companies
The litigation against Bard is officially named MDL 2846 IN RE: Davol, Inc./C.R. Bard, Inc., Polypropylene Hernia Mesh Products Liability Litigation. As of September 3, 2024, there are 24,016 actions pending.
Covidien and Related Companies
The Covidien mass tort is MDL 3029 IN RE: Covidien Hernia Mesh Products Liability Litigation (No. II). As of September 3, 2024, the 1,472 active cases are under the oversight of Chief Judge Patti B. Saris in the U.S. District Court, District of Massachusetts.
Why Are Individuals Suing the Manufacturers in Hernia Mesh Lawsuits?
Individuals are filing lawsuits and joining mass torts against hernia mesh manufacturers because of the serious, debilitating complications that they suffered following hernia repair using these mesh implants. They claim the companies acted negligently by failing to warn of the risks and continuing to market the mesh without consideration of the serious complications or their frequency.
Plaintiffs are seeking compensation for their related medical care, other expenses and losses, and pain and suffering.
How Much Will Settlements Be in the Hernia Mesh Lawsuit?
As of September 2024, there are no known settlement offers in the pending MDLs. This makes it difficult to know how much a settlement might be worth. However, juries have decided on three bellwether trials in MDL 2846. The results of these jury trials include:
- A win for the defense
- A $255,000 verdict against C.R. Bard
- A $500,000 verdict against C.R. Bard, owned by Benton, Dickson & Co.
While these verdicts and awards only apply to the plaintiff in that particular case, it could give an idea of the range of payouts in these cases. One goal of bellwether trials is to see how a jury reacts to the evidence and arguments presented by each side.
What Are the Damages Recoverable in a Hernia Mesh Lawsuit?
The settlement or verdict in a hernia mesh lawsuit will depend significantly on the money you spent and lost because of your hernia complications and required medical care. Your attorney can review the specific expenses and losses incurred in your case, but you could recover:
- Economic damages, such as related medical care and missed income
- Non-economic damages, such as pain and suffering
- Punitive damages, awarded under some circumstances in similar cases
What Is the Timeline for Filing a Hernia Mesh Lawsuit?
How long you have to file your hernia mesh lawsuit depends on several factors. Your home state will likely have a statute of limitations that applies. In addition, the progress of the case could make a difference.
