Who Can File a Depo-Provera Brain Tumor Lawsuit?
Individuals are suing pharmaceutical giant Pfizer for failing to adequately warn them about an increased risk of brain tumors when using Depo-Provera and related drugs. This includes Depo-SubQ or a generic version of the birth control shot.
If you meet the following criteria, you may qualify to join others pursuing justice based on their diagnosis. This includes:
- Have a diagnosed meningioma (malignant or benign), with the diagnosis occurring at least two years after your first injection
- Were prescribed and used one of these medications for at least one year (four consecutive doses) since 1992
You will also need to know where you received the shots, such as at a pharmacy, from your doctor, or at a local Planned Parenthood. This could allow your attorney to retrieve your records as evidence with your permission.
What Damages Might Be Recoverable in a Depo-Provera Brain Tumor Lawsuit?
If you are eligible to file a Depo-Provera brain tumor lawsuit and fight for justice by holding the drug company accountable, you might receive compensation for a wide range of recoverable damages. A personal injury lawyer will have the experience and skills to document these damages and pursue maximum compensation for you.
Some common examples of recoverable damages in a dangerous drug lawsuit include:
- Medical bills and related care costs
- Lost income if you missed work
- Diminished earning ability if you cannot return to work
- Related expenses, such as traveling for care
- Pain and suffering damages
- Some cases may include punitive damages, although this is not common
Some families are also filing lawsuits after they lost loved ones to cancerous brain tumors linked to Depo-Provera use. They can also recover a range of compensation for the expenses and losses they experienced because of their loved one’s illness and death.
What Is the Future of the Depo-Provera Brain Tumor Lawsuits?
The Depo-Provera link to meningiomas became known following the publication of a study in The BMJ in March of 2024. This study showed a significant link between regular use of the shot’s active ingredient, medroxyprogesterone acetate (MPA), and the development of tumors in the membrane that protects the brain.
However, there have been concerns about the potential link between Depo and cancer risk for decades. In 1978, the Food and Drug Administration (FDA) denied approval of Depo-Provera because of the potential cancer risk, specifically due to increased breast cancer risk in animal test subjects. The FDA later approved Depo in 1992.
Because the link between Depo-Provera and meningiomas was discovered so recently, as of November 2024, these cases are still in their earliest stages. There is no way to know how a jury might react to them, how much they might be worth, or if they will eventually be consolidated into multidistrict litigation (MDL).
The Goldwater Law Firm and mass tort lawyers at our partner law firms across the country are monitoring these cases and waiting to see whether the U.S. Panel on Multidistrict Litigation consolidates them. This could change how your case proceeds in the future, but you can still act now by contacting us for your free consultation.
Timeline for Filing a Depo-Provera Brain Tumor Lawsuit
Currently, all cases are moving forward as individual lawsuits in their original jurisdictions. However, multidistrict litigation seems likely since there are many plaintiffs with similar complaints based on the same premise: Depo-Provera causing brain tumors.
Because we are so early in this process, there are no statute of limitations checks for most people looking to file a lawsuit against Pfizer. The only exception is for those filing wrongful death lawsuits. Their state’s statute of limitations would apply, and the clock began ticking on the day of their loved one’s death. We can help as long as you are not within 90 days of the deadline.
