How Do I Know If I Am Eligible to File a Hernia Mesh Lawsuit?

You must meet specific criteria to join the ongoing hernia mesh lawsuits currently in U.S. district courts. In general, if the following apply to you, you could be eligible:

  • You underwent a hernia mesh surgery during January 2010 or later;
  • Your doctors used Bard (Davol, Becton Dickinson) or Covidien (Medtronic, Tyco & US Surgical) mesh;
  • You experienced a significant hernia mesh complication; and
  • You required revision or removal surgery.

At The Goldwater Law Firm, our team can refer you to a dangerous drug or defective product lawyer at one of our law firm partners in your area if you qualify. Reach out to us today for a free case evaluation. We want to discuss the complications you experienced and the necessary treatment for those complications.

What Is the Basis of the Hernia Mesh Lawsuits?

Plaintiffs filing lawsuits against hernia mesh manufacturers allege that these companies failed to adequately warn doctors and patients of the high risk of serious complications related to the mesh implants.

Hernia mesh is used in many—if not most—hernia repair surgeries. This mesh closes the hernia and is generally meant to remain in place permanently. It provides a framework for the nearby tissues to heal. However, many patients report experiencing intense pain and post-surgical complications related to the mesh implant.

These complications include serious infections, adhesions to healthy tissues and internal organs, failure, migration, and more. Many patients require additional repair or revision surgery, which is often far more invasive than the initial hernia repair surgery. They may require more time in the hospital, closer monitoring, a longer recovery time, and more time away from work.

Hernia Mesh Mass Tort Cases Pending

As of September 2024, our co-counsels nationwide are filing lawsuits in two hernia mesh mass torts. Both of these cases are proceeding as multidistrict litigation. This includes:

  1. MDL 2846 IN RE: Davol, Inc./C.R. Bard, Inc., Polypropylene Hernia Mesh Products Liability Litigation
  2. MDL 3029 IN RE: Covidien Hernia Mesh Products Liability Litigation (No. II)

According to the U.S. Judicial Panel on Multidistrict Litigation, these cases had the following actions pending on September 3, 2024:

  • MDL 2846: 24,016
  • MDL 3029: 1,472

Both of these cases are well underway. MDL 2846 has completed three bellwether trials, and mediation was ordered for the fourth bellwether in February 2024. MDL 3029 is still navigating the discovery process.

How Much Could a Hernia Mesh Lawsuit Be Worth?

It is difficult to predict how much any individual claimant might recover from a hernia mesh lawsuit. This is because each hernia mesh settlement or verdict depends on the specific facts of that case. There is no one-size-fits-all answer, and each individual suffered unique expenses and losses. However, some of the recoverable damages in these cases include:

  • Medical bills for mesh complications, current and future
  • Missed income
  • Diminished earning ability for lasting injuries
  • Related expenses
  • Pain and suffering damages

It is worth noting that the juries in two of the three bellwether trials against C.R. Bard, Inc., in MDL 2846 ruled in favor of the plaintiffs. In the second and third cases, the plaintiffs were awarded verdicts that included $255,000 and $500,000, respectively.
