When Can You File a Wrongful Death Lawsuit?

If someone else’s negligence caused your loved one’s fatal accident, you have the right to file a claim or lawsuit for damages. Many different kinds of accidents can lead to a wrongful death, including but not limited to:

  • Car accidents: Over 4,000 people passed away because of motor vehicle accident injuries in the state of Texas in 2024.
  • Truck accidents: Trucks are significantly larger than other vehicles on the road, so they can cause catastrophic damage in a collision.
  • Motorcycle accidents: Motorcyclists, even those who wear helmets and other protective gear, are much more exposed than someone riding in a closed vehicle, making them uniquely vulnerable to severe and fatal injuries.

If you do end up having to file a lawsuit, you have two years from the date of death to do so in most cases. However, you should be aware that certain factors can impact this timeline, and that gathering evidence is generally easier in the immediate aftermath of the accident. The sooner you get started, the better.

In most cases, no, there is no cap on damages. There is one significant exception: if you are filing a lawsuit based on medical malpractice, the amount you can recover in non-economic damages (that is, you and your loved one’s physical and psychological suffering) will be limited.

Other than this cap, you are allowed to ask for as much money as you need to cover all past and projected losses.

The deceased’s spouse, children, and/or parents all have the right to take legal action and recover wrongful death damages. That said, only one of these parties needs to take action to recover compensation for all eligible parties. For example, the deceased’s spouse could file suit for both their own losses and their children’s.

If none of these parties has taken action after three months from the date of death, the deceased’s executor may be able to file a lawsuit instead.

If your loved one was able to complete a personal injury action before succumbing to their injuries, then you are not eligible for any damages they already received. For example, if they were compensated for their medical care, you cannot ask for reimbursement for that same care in your wrongful death action.
