Bayer’s lobbying attempts in Idaho, Iowa, and Missouri all failed. Legislature in all three states did not pass. These states are home to Bayer’s North America crop science division, a RoundupⓇ manufacturing facility, and its glyphosate mines.
Bayer plans to redouble its efforts in next year’s legislative sessions, according to AP News.

In an effort to avoid paying billions more in RoundupⓇ lawsuits, Bayer began lobbying in three different states to shield itself from more claims. Bayer is trying to get lawmakers in Iowa, Missouri, and Idaho to pass bills—with language that Bayer itself provided—that would protect manufacturers from legal action stemming from a failure to warn that their products cause cancer, as long as the label on the product was approved by the Food and Drug Administration (FDA).
The measure did not pass in Idaho but could be approved in Iowa and Missouri, according to CBS News. The bill passed the Iowa Senate on April 5, 2024.

Bayer won a trial against a retired postal worker who alleged that he developed non-Hodgkin’s lymphoma from RoundupⓇ exposure. The plaintiff’s attorney claimed that the Philadelphia Court of Common Pleas jury was not allowed to hear key evidence.

March 1, 2024 was quite a busy day for RoundupⓇ lawsuits.
Update 1:
In 2023, Bayer had appealed the October $175 million RoundupⓇ verdict that a Philadelphia jury ordered. Bayer claimed that a juror had asked the presiding judge, Philadelphia County Court of Common Pleas Judge James C. Crumlish III, how to proceed as the jury was divided 9-3. Judge Crumlish III responded that if the jury could not reach ten votes, they would need to come back for “further deliberations.”
Bayer claimed this was “highly coercive” as the jurors were frustrated by the potential for further deliberations. The juror claimed that those who were undecided or may have supported Bayer decided to change their votes to end deliberations. Bayer requested that a three-judge panel (not including Crumlish) review its post-trial motion.
Judge Crumlish III called the challenge “unfathomable,” “stubborn” and “indignant” and added $2,285,102.74 in “delay damages” to the original verdict.
Update 2:
A Circuit Court of Conway County jury found that Bayer was not responsible for an Arkansas woman’s cancer diagnosis.
Update 3:
Delaware Superior Court Judge Vivian Medinilla declared a mistrial in a RoundupⓇ case on behalf of a South Carolina man who died after being diagnosed with non-Hodgkin’s lymphoma. He worked as a landscaper for more than ten years. The man’s family was seeking $142 million in punitive damages.
The jury deliberated for three days and remained deadlocked, leading to the mistrial, according to U.S. News & World Report.

The 11th U.S. Circuit Court of Appeals in Atlanta did not reject a Georgia doctor’s RoundupⓇ cancer lawsuit despite Bayer’s argument that federal approval protected it from being sued under state law for failure to warn of a product’s potential risks, according to Insurance Journal.
A Philadelphia appeals court is considering the same issue.

A Philadelphia, PA jury ordered Bayer to pay a Pennsylvania man $2.25 billion in damages after he alleged that RoundupⓇ caused him to develop cancer. According to an NBC News article, the jury awarded $2 billion in punitive damages.

Glyphosate is a chemical commonly used in many herbicides and the main active ingredient in many products within the Roundup® family. It works by inhibiting an enzyme essential to plant growth.
While Bayer and Monsanto continue to claim that their glyphosate-based weed killer does not cause cancer, the cancer research agency of the World Health Organization (IARC) issued a report in 2015 stating that the chemical is likely carcinogenic.
This report was supported by various studies that provided convincing evidence from the United States, Canada, and Sweden.
RoundupⓇ exposure has been linked to:
- Non-Hodgkin’s lymphoma
- Chronic lymphocytic leukemia
- Mantle cell lymphoma
- Hairy cell leukemia
- B- and T-cell lymphoma
In the abstract of a 1986 article published in JAMA, farmers who used herbicides for more than 20 days a year had a six-times higher risk of non-Hodgkin’s lymphoma than non-farmers. Those who mixed and regularly applied the herbicide had an eight times higher risk.
Both Monsanto and Bayer claim RoundupⓇ is safe.
The studies initiated and undertaken by the IARC focused on studies conducted in lab rats. While the scientific evidence that directly links glyphosate and cancer in humans is still being explored, the studies also indicated that farmers and agricultural workers who were exposed to the chemical in high concentrations developed cancer at higher rates than others. Thus, it is believed that there is an association between regular glyphosate exposure and the development of non-Hodgkin’s lymphoma.
One study performed by researchers from the University of Washington found that there is a 41% higher risk of non-Hodgkin’s lymphoma in people exposed to glyphosate-based herbicides when compared to people who had not been exposed.
Plaintiffs are alleging that Monsanto and Bayer knew about the potential risks of glyphosate or at some point became aware that the serious health risks existed, yet took no action to warn the public about the potential dangers of RoundupⓇ.
